Abstract

The present investigation is developed under the objective of analyzing the perspective of comparative law, among which the United States legislation, recognized as Common Law, the Chilean Legislation and the Argentine Legislation, intervene. The problem lies in the times of sanction, because although the Comprehensive Organic Criminal Code does not establish major or minor offenses, a range can be verified by the dosimetry of the sanction, according to this range and according to an edge of analytical development. of the investigation, the Common Law, exposes this, as a parameter so that whoever exercises jurisdiction in the exercise of criminal action, is a jury or a court in the Ecuadorian case. The methodology applied in research with a qualitative and quantitative approach with deductive design. It is concluded that the abbreviated procedure should not be applied in all crimes, since being coherent with the comparative analysis of law developed throughout the investigation, all the laws have a ceiling of application of the abbreviated procedure, being the Ecuadorian case specifically ten years old. It should be noted that Ecuadorian legislation has one of the highest rates in relation to the others, this is given in relation to the proportionality of the high dosimetry, in the punishment of crimes.
