Resumen
Este estudio evaluó la coherencia entre la gravedad del hecho y la severidad de la respuesta judicial en sentencias por delitos contra la fauna silvestre, triangulando con percepciones institucionales. Se sistematizaron cinco sentencias entre el 2018 y 2020 y se analizaron entrevistas funcionales; se compararon, conducta delictiva, evidencia, agravantes, pena, multa, reparación, fecha, tribunal y observaciones probatorias, combinando estadística descriptiva y análisis temático de categorías (bienes traficados, especies afectadas y procedimiento de custodia). Se identificaron tres patrones: predominio de carne de monte y partes anatómicas sobre animales vivos; gran variabilidad en las multas y en la definición de reparación; y reiteradas deficiencias en la cadena de custodia y peritajes. La severidad de la sanción evidenció heterogeneidad respecto a agravantes. Se propone un checklist para apoyar la proporcionalidad de la sanción y estandarizar la reparación. La matriz comparativa utilizada es replicable a nivel cantonal y útil para futuras comparaciones provinciales.
